By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Scope of Services

Recreation Stays provides vacation rental management services and booking platforms for guests and property owners. These Terms apply to all users of our website, platforms, and services.

2. Acceptance of Terms

By accessing or using our website, booking a property, or otherwise interacting with our services, you agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms, you may not use our services.

These Terms incorporate our Privacy Policy by reference. Please review it to understand how we collect, use, and protect your personal information. Recreation Stays provides vacation rental management services and booking platforms for guests and property owners. These Terms apply to all users of our website, platforms, and services.

3. Use of the Site and Services

You agree to:

  • Use the website and services only for lawful purposes.
  • Provide accurate, current, and complete information when prompted.
  • Refrain from using automated tools to scrape, collect, or harvest data.
  • Not attempt to access unauthorized areas of the website or systems.

We reserve the right to suspend or terminate access if we believe you have violated these Terms or engaged in any unlawful or harmful activity.

4. Booking, Refund & Cancellation Policy

All reservations are subject to the specific cancellation and refund policy selected at the time of booking, which may vary depending on the booking platform (e.g., Airbnb, Vrbo, direct).

A. Cancellation and Refund Terms
  • The cancellation terms associated with your reservation are binding and were presented at the time of booking.
  • Recreation Stays strictly adheres to these terms and is not authorized to modify them after confirmation.
  • Refunds will be issued only in accordance with the cancellation policy in place at the time of booking.
B. Extenuating Circumstances
  • In rare cases (e.g., verified illness, natural disaster, or force majeure events), guests may request an exception by providing valid documentation.
  • Approval of such requests is discretionary and may be subject to platform-specific rules or third-party policies.
C. Non-Refundable Fees

  • Any service, cleaning, or platform fees charged by third-party booking platforms are generally non-refundable, even in cases of approved cancellations.

D. Reservation Modifications

  • Any changes to check-in or check-out dates are subject to availability and may result in pricing adjustments or affect refund eligibility.

E. Refund Timing
  • Approved refunds will be processed within 30 business days of cancellation confirmation or approval of an extenuating circumstance.
  • Actual refund timing may vary depending on the payment method, financial institution, or third-party booking platform.
  • Recreation Stays is not liable for delays caused by payment processors or external platforms.

5. Guest Responsibilities

Guests agree to:

  • Abide by all house rules and occupancy limits.
  • Treat the property with care and report any damages immediately.
  • Refrain from engaging in illegal or disruptive behavior.
  • Respect neighbors and local ordinances, including noise limits.
  • Failure to comply may result in additional fees, eviction without refund, or legal action.

6. Smart Devices and Monitoring

For security and operational reasons, some properties include:

  • Smart Locks (all properties): Used for secure keyless entry.
  • Noise Sensors (some properties): Monitor sound levels to prevent disturbances. Do not record conversations.
  • Exterior Security Cameras (some properties): Only monitor entryways and public-facing areas. No surveillance of private areas.

Guests are notified of these devices in advance. Use of these technologies complies with privacy regulations.

7. Intellectual Property

All content on our website and platforms, including text, images, logos, and software, is owned by or licensed to Recreation Stays and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Recreation Stays is not liable for:

  • Personal injury, property damage, or loss arising from your use of a rental property.
  • Errors or omissions in listing content.
  • Service outages or interruptions.
  • Acts or omissions of third parties, including owners and booking platforms.

Our liability is limited to the amount paid by you for the specific booking.

9. Indemnification

You agree to indemnify and hold harmless Recreation Stays, its employees, affiliates, and partners from any claims, damages, or expenses arising from your violation of these Terms or misuse of the services.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Washington. Any disputes arising from these Terms shall be resolved in the courts located in King County, Washington, unless otherwise required by applicable law.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the revised Terms. The “Last Updated” date at the top reflects the most recent changes.

12. Additional Terms and Disclaimers

A. Force Majeure

Recreation Stays is not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, government orders, pandemics, utility outages, labor strikes, or acts of God.

B. Third-Party Platforms

When you book through third-party platforms, you are also subject to their terms and conditions. Recreation Stays is not responsible for platform errors, account issues, payment delays, or policy enforcement outside of our control.

C. Dispute Resolution

Any dispute or claim arising out of or in connection with these Terms shall first be attempted to be resolved through informal negotiation. If not resolved, the matter will be submitted to binding arbitration under the rules of the American Arbitration Association in Seattle, Washington, unless otherwise required by law.

D. Damage Recovery

Guests are responsible for any damage to the property beyond normal wear and tear. Recreation Stays reserves the right to recover costs for repairs or replacements, including by charging the payment method on file or pursuing collection, if necessary. Property may be inspected after departure.

E. Right to Modify or Cancel Reservations

Recreation Stays reserves the right to cancel or modify a reservation due to unforeseen circumstances, including property damage, system errors, or availability conflicts. In such cases, guests will be offered a refund or alternative accommodation where possible.

F. Guest Misconduct and Stay Termination

Recreation Stays or its representatives may terminate a guest’s stay without refund if there is evidence of rule violations, damage, illegal activity, or behavior that endangers the property, staff, neighbors, or other guests.

G. No Guarantee Clause

We make no guarantee that any amenity, feature, or service (including Wi-Fi, utilities, or appliances) will be available or uninterrupted. Recreation Stays is not liable for any inconvenience or indirect losses resulting from unavailability.

H. Denial of Service

Recreation Stays reserves the right to deny service or cancel a reservation at our sole discretion, including but not limited to situations involving incomplete guest information, verification failure, or behavior inconsistent with our policies.

I. Photography and Marketing Use

By using our services, you consent to Recreation Stays photographing or filming properties (not guests) for marketing, documentation, or quality assurance purposes. No personally identifying guest images will be used without written consent.

J. Check-In / Check-Out

Check-in and check-out times are specified in your reservation confirmation. Early check-in or late checkout requests must be approved in writing and may incur additional fees. Unauthorized late checkout may result in penalty charges or removal.

K. No Tenancy Created

Use of our properties is strictly limited to temporary, short-term accommodations. No tenancy or landlord-tenant relationship is created under any circumstances.

L. Pet Policy

Pet policies vary by property. Please review the specific listing for pet rules. Unauthorized pets may result in additional cleaning fees or cancellation of stay without refund.

M. Travel Insurance Recommendation

We strongly recommend that guests purchase travel insurance to cover unexpected events, including illness, weather disruptions, or personal emergencies. Recreation Stays is not liable for losses related to such events.

N. Third-Party Services Disclaimer

Recreation Stays may recommend or facilitate third-party services (e.g., tours, in-home chefs, spa treatments). These are provided by independent vendors, and we are not liable for their performance, safety, or conduct.

O. Public Reviews and Disparagement

Guests are encouraged to provide honest feedback about their experience. However, by using our services, you agree not to make any false, defamatory, or misleading public statements about Recreation Stays, its employees, or its properties. We reserve the right to respond to public claims and to pursue appropriate legal remedies in cases of knowingly false or malicious content.

If you have concerns during or after your stay, we strongly encourage you to contact us directly to resolve the issue before posting a public review.

P. Minimum Age Requirement

Guests must be at least 18 years old to make a reservation. Some properties may require a minimum age of 21. By booking, you confirm that you meet the minimum age requirement and are authorized to make the reservation.

Q. House Rules Enforcement

House rules are considered part of these Terms and are made available through your reservation confirmation, guest guidebook, or direct communication. They may include restrictions related to noise, occupancy, pets, parking, or use of amenities. Failure to comply may result in additional charges or early termination of the stay.

R. Payment Authorization

By making a reservation, you authorize Recreation Stays to charge the payment method on file for any applicable charges, including booking costs, damages, late checkout fees, unauthorized pets, excessive cleaning, or other verified violations of these Terms or the applicable house rules.

13. Entire Agreement

These Terms, along with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Recreation Stays and supersede any prior communications or understandings, whether oral or written.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15. Survivability

The provisions of these Terms that by their nature should survive termination (including Sections 8, 9, 10, and 12) shall remain in effect even after your stay ends or your use of our services ceases.
